Facilities must not require or discriminate based on whether a resident has an advance directive, and cannot condition care on its presence. Staff are not required to provide care that conflicts with an advance directive when state law allows conscientious objection. Providers must also maintain written policies and procedures that guide staff through admission‑related steps and ensure residents retain these rights throughout their stay.
