The New York State Department of Health (NYSDOH) issued a DAL on June 4, 2025, “Nurse Aide Training and Competency Evaluation Program Waiver and Appeal Requirements.” The DAL was issued to clarify information regarding the Nurse Aide Training Program.
Highlights/ reminders include that a skilled nursing facility may not have a CNA training program when it:
- is operating under a waiver for RN coverage due to a deviation in the 24/7 RN requirement.
- has been subjected to a partial extended survey or extended survey.
- has been assessed a CMP of at least $13,343 as a result of a survey.
- Has had a denial of payment, temporary manager imposed or is subject to termination.
The facility may apply for a waiver to regain its ability to offer the program after a two-year ban. DOH notes that it has limited ability to review and approve these waivers.
