The Freedom from Abuse, Neglect, and Exploitation regulatory group establishes CMS requirements for protecting residents from every form of abuse, neglect, exploitation, and improper restraint — and for the systems facilities must have in place to prevent, identify, report, investigate, and correct these situations. This is one of the most consequential regulatory groups in the nursing home survey process. Citations here frequently carry higher scope and severity, and deficiencies in this group can trigger Substandard Quality of Care findings.

Free from Abuse and Neglect (4-Part Series)

The foundational abuse and neglect tag — covering every form of resident abuse including physical, verbal, sexual, and mental abuse, as well as neglect. CMSCG's four-part series covers definitions, risk factors, facility responsibilities, staff-to-resident and resident-to-resident situations, sexual abuse indicators and response, and the distinct regulatory treatment of neglect.

Free from Misappropriation/Exploitation

Residents must be protected from misappropriation of their property and financial exploitation. This tag covers staff theft, unauthorized use of resident funds or possessions, and coercive or deceptive practices that exploit residents' vulnerability.

Free from Involuntary Seclusion

Residents cannot be confined to their room, a specific area, or isolated from others as a disciplinary measure or for staff convenience. Understanding what constitutes involuntary seclusion — and how it differs from clinically justified isolation — is essential for compliance in this area.

Right to Be Free from Physical Restraints (3-Part Series)

Physical restraints may only be used when clinically necessary, properly ordered, consented to, and monitored — never for staff convenience or discipline. Not Employ/Engage Staff with Adverse Actions

Facilities may not employ or engage individuals who have been found guilty of abuse, neglect, or mistreatment — or who have had a finding entered on the state nurse aide registry for abuse or neglect. Background check and registry screening processes must be airtight.

Develop/Implement Abuse/Neglect Prevention Policies

Every facility must develop and implement policies and procedures to prohibit and prevent abuse, neglect, exploitation, and mistreatment — and those policies must be operationalized, not just documented. Having a policy manual doesn't mean having a compliance program.

Reporting of Alleged Violations

Facilities must report alleged violations of abuse, neglect, and exploitation to the state survey agency and other required authorities within specific timeframes — and the reporting obligation applies regardless of whether the allegation has been investigated or substantiated.

Facilities must investigate all allegations of abuse, neglect, and exploitation — thoroughly, promptly, and without interference — and implement corrective actions to prevent recurrence. The investigation process itself is subject to surveyor review.
